Black Slot: AAMS ordered to pay one million euros in damages

(Jamma) – The Civil Court of Rome has sentenced AAMS to compensate a manager for the affair related to the disposal of the Black Slots.
Between loss of profit, emerging damage, interest and expenses: over one million euros.
The Court, following the technical consultancy proving the regularity of the equipment, deemed AAMS' responsibility independent of the events connected with the criminal proceeding in Venice and completely independent of the developments of that proceeding in consideration of the disposal order issued by AAMS on 16 January 2007 following revocation of the certificate of conformity on 22 December 2006.

 

 

But the reasoning of the Court of the Capital nails AAMS both in the eventuality of non-compliance of the devices, and in the different hypothesis of their regularity.

 

 

 

In the first case, the Judge observed, AAMS would in any case be liable for having issued the certificates of conformity in the face of irregular devices, in the second case the liability would materialize in the Administration's rethinking, in the face of legal and legally compliant devices.

 

 

 

The objection of lack of legitimacy raised by AAMS was rejected, which argued that the manager should have directly and only sued the counterpart company. On this point, the Court of Rome instead identified the total responsibility of AAMS, which generated trust in the operator who purchased the devices based on the existence of the certificate of conformity issued by the same administration.
The sentence is provisionally enforceable.
