Acquitted, or rather acquitted so as not to have to prosecute, owner of a betting center located in the province of Agrigento, defended bylawyer Marco Ripamonti.
The same defendant had been tried a year earlier for the same crime of illegal collection of bets and had been acquitted with the fact that the fact does not exist, due to the lack of proof regarding intermediation activities and the existence of discriminatory profiles inherent to the position of the bookmaker with whom was connected.
Thesis represented by the same lawyer Marco Ripamonti, by whom he was always assisted.
The latter defender, in the second trial, argued that it is not possible, in the face of the same activity, carried out in the same financial year, to be tried several times following multiple complaints for the same crime, if not violating the principle of ne bis in idem, which prohibits being tried twice for the same crime.
The Court of Agrigento, at the hearing on 13 November 2023, agreed with the defense thesis and ruled accordingly.
