The "Financial Investigations" regarding "PUBLIC GAMES". An effective tool to combat tax evasion also in the field of games and bets?

(Jamma) – The Grassi Law Firm, with a contribution edited by Rossella e Alessandra Grassi ([email protected]), observes how, for some time now, a massive work of codification of the cases, and the related economic, fiscal and political-social implications, relating to the world of games and betting has been started by the national Legislator; regulatory activity which had the main purpose of regulating the sector in order to counter the spread of illegal phenomena, to protect the interests of authorized operators operating in the sector and to reduce the related social risks.

A specific regulatory action has, in fact, taken into consideration precisely the action to contrast those unlawful and fraudulent conducts perpetrated in the sector in question, reducing the scope of application of regulatory instruments, indeed, already in use in our legal system, the application of which has the specific gaming and betting sector is also involved. Among the various legal provisions of interest in this sense, it is worth drawing attention to the provisions of art. 15, paragraph 8 duodecies of Legislative Decree no. 78/2009 with which the Offices of the then Autonomous Administration of State Monopolies (AAMS), now the Customs and Monopolies Agency, were granted the attributions and powers provided for by articles 51 and 52 of the Presidential Decree of 26 October 1972, n. 633, including the possibility of carrying out the procedure of the cc.dd. "Financial investigations" according to the terms and conditions set forth in art. 51, paragraph 2, nos. 2 and 7 of Presidential Decree no. 633/1972. The topic just outlined offers, according to the Grassi Law Firm, the starting point to draw attention to the disruptive application scope of these provisions and the relationship between them and the discipline that regulates the taxation of games, bets and betting competitions .
