(Jamma) When will the adoption of the appropriate measures to identify specific criteria for calculating the relevant balances for the purposes of compliance with the internal stability pact for the municipality of Campione d'Italia, in consideration of its exceptional condition of extraterritoriality? The question, after being accepted in an odg within the decree on the debts of the public administration and falling into oblivion, has been re-proposed in recent days by the honorable members of the Pd Braga and Guerra who presented a question to the Minister of the Economy and Finance and the Minister of the Interior.
“During the examination by the Chamber of the decree-law n. 35 of 2013, the Government - we read - accepted the agenda signed by deputies Braga, Guerra, Bobba, which commits the executive to adopt, within the deadline for the approval of the municipal budget, the appropriate provisions, also of an interpretative nature, in order to identify specific criteria for calculating the relevant balances for the purposes of compliance with the internal stability pact for the municipality of Campione d'Italia, in consideration of its exceptional extra-territorial condition, the consequent peculiarity of the functions and activities performed, the particularity of the resources and expenses in Swiss francs of the institution's budget, defining a calculation basis to which to apply the legal coefficient to identify the so-called target balance consisting only of current expenses for the three-year period 2007/2009 strictly linked to the performance of typically municipal functions, therefore deducting all those expenses in Swiss francs of cu i the municipal administration takes charge due to its particular geographical location as an exclave.
The municipality of Campione d'Italia, - they recalled - being entirely surrounded by Swiss territory even though it is part of the province of Como and therefore of the Italian Republic, has a peculiar geographical location: also considered by the EU non-customs legislation, it falls within a area considered reference customs area of the Swiss Confederation and, as a result of this, the currency used by its inhabitants for transactions is the Swiss franc, currency also used for drawing up the municipal budget.
The location of exclave Italy has induced the Government, as early as 1933, to authorize the opening of a gambling house to enable the financing of the municipal budget. The municipality, with its share of the proceeds in Swiss francs due to it, can give financial coverage to the institutional expenses of the territorial body and above all to the particular measures in favor of its citizens required by the territorial interclusion of the municipality; the legislator has always determined the amount of this contribution in Swiss francs on the proceeds of the gambling house with the sole purpose of ensuring the municipality of Campione d'Italia the adequacy of the financial means to deal with a very particular situation, which it can be compared with other similar realities in terms of demographic size or territorial extension;
the share of proceeds attributable to the municipality, until now determined by law, serves not only to finance specific activities in the institution's institutional sphere, but also other public services delegated to the municipality of Campione d'Italia which, in the rest of the country, are the exclusive competence of central authorities".
For this reason, they ask: "in order to fulfill the commitment undertaken in accepting the aforementioned agenda, what specific initiatives and, with what timing, does the Government intend to take, in order to define a distinct method for calculating the relevant balances for compliance with the internal stability pact of the municipality of Campione d'Italia, consequently defining a calculation basis to which the law coefficient can be applied to identify the target balance consisting only of current expenses for the three-year period 2007/2009 closely linked to typically municipal functions and therefore, net of all those expenses in Swiss francs which the municipality of Campione d'Italia bears due to its particular geographical location”.
