Games. Corte Conti rejects Monti government measures, unreliable use of proceeds from the gaming sector

(Jamma) Referral to secondary measures; amendments without a technical report; unreliable covers; improper use of Treasury funds: the Court of Auditors rejects the provisions of the Monti government of the last quarter of 2012, budget law and development law included. On hedging, it highlights the "improper use of treasury funds" e the use of proceeds from gaming and excise duties from "unreliable" revenue. The stability law then "does not carry out the manoeuvre".

In particular: the frequent referral to secondary implementing measures. Continuous changes in laws, even recent ones, with effects on the reliability of the estimates regarding the financial effects brought about by the regulations. Approval of amendments without the technical report or for which the technical report appears to have been endorsed negatively by the Ministry of the Economy. Use of assets for hedging purposes, such as proceeds from gaming and excise duties on hydrocarbons, whose revenue is declining and whose estimates therefore appear unreliable and the improper use of treasury funds to cover budget charges.

 

For the Court of Auditors, the rules under accusation are, in particular, the one that expands the types permitted for machines for lawful gaming without cash prizes. This is the provision under which they are authorised redemptions. "The Ministry of the Economy - the judges explain - pointed out that a technical report would have been appropriate that had supported the implicit hypothesis of the absence of negative changes in revenue or in any case had reported an overall quantification of the effects" .

We then point out the rule according to which starting from 1 January 2013, the amount of the single tax levy (PREU) on so-called video lottery machines is set at 5 percent of the amount of the stakes. The expected higher revenue has been estimated at 130 million per year, assuming a collection of 26 billion euro. “ The figure runs the risk of overestimating the "net" effect of the maneuver, in the sense that the estimate reflects a "coeteris paribus" approach, without taking into account "substitution" phenomena, in which the development of a gaming market sector accompanies the contraction of others. In particular, however, the different profitability of the individual games must be taken into account, which can vary from 50 per cent to 5 per cent, with the consequence that the expected effects should be correlated to an analytical verification of the performance of the individual games.
