The petitioner considers that the prohibition in question is disproportionate to the objective of discouraging pathological gambling and constitutes a clear violation of the freedom of establishment (Article 49 TFEU) and freedom to provide services (Article 56 TFEU) and leads to a distortion of competition between commercial operators who manage the devices in question according to their location.
