The Regional Court of Administrative Justice Autonomous Section of Bolzano and the Regional Court of Administrative Justice of Trento, with two separate orders, accepted the appeals of two operators and granted the suspension of the effectiveness of the closure measures of two gaming halls.

The lawyer who represented the operators, lawyer Geronimo CardiaSaid:

"In a short time, two precautionary orders were issued suspending the closures of two cinemas. One in the Province of Trento and one in the Province of Bolzano.

With these provisional measures, the respective TARs have ensured that tax revenue, user protection, legality and employment levels can continue to be ensured in their respective territories.
But for a limited period of time because their effectiveness must be registered until the outcome of the respective substantive discussions, unless they are accepted.

In one case (that of the province of Bolzano) there are also specificities at stake (such as the unproven sensitive nature of the place allegedly too close to the room).
While in both cases the more general issue of the expulsive effect of the distance meters in question continues to arise which, despite the proclaimed high percentage numbers of interdiction, continue to not be censured in court.

In the meantime, let's see what the delegated Legislative Decrees will be able to do in implementation of the Enabling Law which in its version approved in July declares that it intends to resolve the territorial issue".
