With the rulings just released, the Council of State has expressed its opinion on the Trento distance meter, saving the provisions that will lead to the closure of many businesses and the loss of jobs.

“The ruling of the Council of State – comments the lawyer Geronomo Cardia – decides not to apply the union principles dear to the Court of Justice, without prejudice to the Trento distance meter, thereby departing from the well-known precedent of the Spanish Court, stating that the legislation in the case cited would be much more onerous than the Italian one, providing for a ban on access to minors and a ban on advertising. All this without considering that in Italy there is both a ban and a self-exclusion register for some types of games.
Furthermore, the Spanish precedent also highlights a principle of discrimination on prohibitions applied to certain types of games and not to others.
Another opportunity has therefore been missed to overcome the institutional short circuit of the conflict between national legislation and local legislation.
Now in the province of Trento we will proceed with closures, with the loss of tax revenue, of legality of employment levels and above all of user protection.
While the online reorganization has started, all that remains is to see if and when the territorial one will allow us to proceed with overcoming the territorial issue that blocks everything, including competitions."
