(Jamma) The paradoxes of our legal/regulatory system are many. Among these, the new Title V of the Constitution stands out, the most classic of Pyrrhic victories for those who obtained it at the time. In fact, a mammoth duplication of costs between the central State and the Regions resulted from that wicked reform, which – ironically – is precisely what justifies the existence of the latter to date. The unwritten rule says that those with the most debts are kept alive, those with few, prosecuted. And here, in order to chase crumbling budget balances, these entities, born as territorial and which have become de facto sovereign, are chasing without respite new competences to be subtracted from the central State, such as to allow them additional income and reasons for living. The latest idea is to take possession of the gaming and betting sector, again in contempt of constitutional dictates.

The assumptions of these expansive projects of the Regions often rest on situations that are actually sensitive, or on which the State is not responsive, certainly appreciable from the media, which attract an audience, in other words. Then that of gaming, which has suddenly become the most dealt with problem in the country (it seems that the number of interventions by parliamentarians and local public exponents with related draft laws, regulations, amendments, etc., far exceeds that dedicated to any other subject: this terrifies us!) it arouses so much consensus that no one dares to talk about it except in the negative. Thus, in the face of the regulatory interference of the Regions, the Presidency of the Council has well thought of not asking the question of constitutionality. For heaven's sake, everyone does their own accounts at home and adjusts accordingly. The fact is that if today is the game, what will it be tomorrow? That is, if one hides one's head in the sand due to the fragility of the executive (and indeed with the motion on the moratorium on concessions some have already tried to bring down the government using the sensitive issue "game") there is a risk of expropriation of powers in favor of territorial entities with an inversion of that principle of subsidiarity which instead we so much invoke in relation to Europe. All this absolutely does not want to deny, but rather to enhance the role that the real territorial bodies, i.e. the Municipalities, can play better for the citizens, also and above all in the public gaming sector. This is not to say that there is suddenly widespread competence to establish new casinos. According to some, a transversal movement is born from this that enhances the media delegitimization campaign in place in the sector to obtain this result, with the related interests involved). The interlocution of the ANCI and the fact that Minister Del Rio was its historical president, is fundamental in the re-foundation of the organization of the game on the ground, certainly assisted by the essential skills of the sector, and by those acquired with difficulty over the years, of the relevant regulatory bodies. As always in all things - but unfortunately not everyone agrees - we need to work, and work hard, investigating and evaluating every single aspect of a sensible project that reviews the gaming phenomenon in the light of the territory, of the sociological development of the country in the medium term, of the technological offer both nationally and globally. Without getting drawn into a religious struggle (sic!) which would only risk creating spaces of impunity for the most unscrupulous.
