Betting and Internet points: Court of Criminal Appeal of Palermo acquits

First degree conviction sentence rendered in Agrigento for the crime referred to in article 4 of law 401/89 (two years of imprisonment, plus additional sanctions) fully reformed by Court of Appeal of Palermo, which thus accepted the appeal presented by the defence, supported by the lawyer.Mark Ripamonti.
The defendant managed an internet point, where during an inspection by the police forces, computers connected to the internet, gaming receipts, window stickers, schedules and magazines relating to the prices of sporting events were found. On appeal, the defense argued the inconsistency of the accusation, based on circumstantial elements unsuitable to form proof of intermediation, as it could not be ruled out that any bets were placed directly by the customers.
The Court of Appeal, following the discussion which took place on 8 November 2023, held by the same lawyer Marco Ripamonti, reversed the conviction and acquitted the accused with the formula that the fact does not exist. Satisfaction was expressed by the professional from Viterbo, who is also currently involved in other proceedings in the Sicilian capital.
