The operator promises to fight on all fronts against the judgment deemed “unfair” by the Dutch regulatory authority (KSA)

Gambix Limited announced their intention to challenge the “outrageous and unfounded” fine imposed on them by the Dutch Gambling Authority (KSA).

Gammix said the record €19,7 million fine imposed was based on “falsified data, extreme inaccuracy and highly suspect mathematics”.

In the ruling, the regulator said that Gammix was found to have allowed access to online gambling for Dutch consumers, as well as not requiring age verification when signing up, which the company contests wholeheartedly.

Gammix reports that the accounts used to access its sites during the investigation were created in Luxembourg, with deposits made via credit card. Gammix added that such action violates the sites' terms and conditions, especially providing false information when signing up.

The operator states that the fine, amounting to 19.679.000 euros, was calculated using data from a proprietary web traffic aggregation service and a multiplier of 240 euros per click. Gammix believes that this would demonstrate a turnover that does not exist.

Furthermore, Gammix strongly condemns the KSA's "mystery shopper" investigation style, which, the operator claims, is an unfair basis for this record-breaking fine.

Phil Pearson, director of Gammix Limited, he promised to “fight on all fronts until he receives an apology and retraction".

He said: "ksa has imposed a fine on our company that is both outrageous and unfounded. Now that we are able to talk openly about the case, we can confirm that we are fighting on all fronts as, for us, this is an extraordinary and unnecessarily heavy-handed action by a regulator that many already considered unapproachable.

When we received the first notice of a possible fine, we contacted them to say we had blocks in place. We also asked for any information they had that was relevant to the investigation, to ensure we remained in compliance with all guidelines, a request they appeared to ignore. Our lawyers also approached the regulator, in writing, for more information, but again no response was received.

We had enabled a block on Cloudflare for any Dutch IP, we do not have the Dutch language or direct Dutch payment methods and we categorically do not target Dutch traffic. If affiliates advertise one of our brands on sites targeting the Netherlands, we cannot be held responsible for such promotions. However, once reaching the final site, players would not be able to register an account".

Pearson concluded: “This fine is an absolute joke and we will contest it in every way possible, at every moment possible. We will only stop after this outrageous fine has been lifted and we have received the apology we deserve".
