The Council of State rejected the appeal for the annulment of the refusal to issue an authorization to open a games room to a person that the police station considered could not meet the requirements.
” The assessment of reliability in the very delicate sector of games and bets involves the person of the owner in his family and friends ties - reads the provision - in the present case, in addition to family relationships, the appellant's acquaintances are relevant which - contrary to what deduced in the appeal – do not all date back to a time when he was a minor.
Nor does the vice of contradiction exist in the decisions of the Administration, which presupposes the identity of the situations, a circumstance which in the present case does not occur, taking into account both the appellant's acquaintances with contraindicated subjects, and the different location of the two businesses ( that of the sister and that of the appellant) given that, in the case in question, the room is located in the immediate vicinity of the one where her parents operate"
