“With Provision no. 15943/2023, the Revenue Agency approved the new version of the technical specifications for the electronic storage and telematic transmission of daily fees ("RT Technical Specifications - Version 11"), which provide the indications for proceeding, by 2 October next, with the adaptation of the telematic Registers to make them compliant with the new provisions relating to the transmission of data for the instant fee lottery (see Fipe news 26.06.2023)". This is what the Italian Federation of Public Exercises communicates in a note.
"Among these specifications is also provided for the fulfillment referred to the "idle period" of the financial year, in relation to which paragraph 2.7 establishes that "[...] In the event that the interruption of the activity exceeds 12 days (for example long holidays, seasonal closure, temporary inactivity, etc.) [...], the Electronic Register must provide for the possibility of preparing the sending of an "out of service" type event, code 608 (warehouse/inactivity period), to notify the system of the beginning of the inactivity period. In this case the RT will return "In service" to the first useful transmission".
The aforementioned technical specifications - continues the note - must be complied with by the new models of Electronic Register for which an application for approval is presented after 30 June 2023, while for models already approved they must be complied with only in the case of presentation of an application for a variant after 30 June 2023.
Therefore, it should be clarified that:
- for RTs not yet approved (eg those that are now being purchased by merchants), the merchant will have to ensure that they comply with the technical specifications immediately (including the fulfillment of the "downtime");
- for RTs already in use by businesses (and therefore already approved before 30 June), the adjustment relating to the inactivity period may be completed at the same time as the adjustment relating to the instant lottery, and in any case no later than 2 October 2023.
