ACOGI Council of State: the tender for 2 concessions in the sights

(Jamma) "The Council of State - writes the Associazione Consmatori Operatori Giochi Italia in a note - is analyzing the appeals of operators who have received the halt of the Lazio TAR with respect to the appeals presented against the Monti Bando, the one which, due to the Italian horse racing and sports betting, and for virtual games, they put out a tender for 2 concession rights.

About a month ago, the highest administrative justice body in Italy had discussed Stanley's appeal, deciding, with a non-definitive, very articulated sentence of more than 100 pages, not to decide on the merits and to refer everything to the European Court of Justice because if would take care of it. It will therefore be the umpteenth time and the umpteenth tender procedure that the judges of the Court of Justice will have to deal with. We will have to wait a couple of years, and the main reason that led the Council of State to postpone the judgment to Luxembourg concerns the short duration of the concessions (40 months) which is unable to justify a substantial investment by foreign operators who, having to establish themselves from scratch on the Italian market, they would have had to undergo very considerable outlays.
Other appeals, therefore, should also have the same solution given that the reason on which most of the appeals are based is precisely the brevity of the duration of the concessions provided for by the Call".
