Promo Games: Absolution in Forlì

(Jamma) – The Court of Forlì, with a sentence of 2 December 2013, acquitted the installer of totems and the owner of the amusement arcade business, called to answer for the crime of illegal collection pursuant to article 4 of law 401/89, for having positioned totems aimed at e-commerce activities with promotional games.


The lawyer Marco Ripamonti of the Court of Viterbo, defender of the defendants, filed a defense brief with attachments the commercial license of SIM Mobilien, the Austrian company owner of the service and a technical report on the functioning of the playnetisland portal, as well as numerous sentences and re-examination orders related precisely to the case of the Austrian company.
Among the witnesses questioned in the preliminary investigation also the Director of the AAMS Office for Emilia Romagna, who had supervised the seizure operations, who confirmed the traceability of the devices to the category of totems, however excluding any form of intermediation by the owner of the business.
At the end of the discussion, an acquittal sentence was received.
