“The regulations referred to in regional law no. 9/2018 - which applies to the present case - presents aspects of questionability in terms of a systematic reading of paragraphs 3 and 13 of the art. 16 with reference to the extensibility of distance limits to betting shops without machines for the game; considered that, in balancing the opposing interests, the precautionary needs of the appellant can be adequately satisfied by arriving at a prompt definition on the merits that settles the decision-making issue of the dispute".
The Council of State, with an order dated 23 February, requested that a hearing on the merits be scheduled in reference to the appeal presented by a gaming operator, represented by the lawyer Luke Jacob, against the regional law of Calabria which extends the distance meter to betting shops without slots.
