Following the verification activity carried out after several reports concerning conduct relevant to compliance with the prohibition established by art. 9 of the dignity decree implemented by Google in relation to the YouTube video sharing platform, the presence of numerous channels containing multiple videos with promotional or otherwise promotional content was found
advertising, even indirect, relating to games or bets with cash winnings or
invitation to practice gambling.
AGCOM ORDERS to the company Google Ireland Limited, with registered office in Gordon House, Barrow
Street, Dublin 4 (Ireland) to pay the administrative fine of €450.000,00
net of any other additional charges that may be due, for the violation of the provisions contained in article 9 of the legislative decree of 12 July 2018, n. 87, converted with law 9 August 2018, n. 96;
- to remove from the video sharing platform "YouTube" the videos uploaded after the notification of this resolution by the content creator "Spike" identified above whose contents are similar or equivalent to those covered by this proceeding and to notify the Authority within 10 days.
